General Terms of Service with the Organizer

By creating an event in the Ticks system, the Organizer declares that they understand and accept Ticks' general terms of use, Ticks' terms for organizers, as well as the Data Protection Statement

Ticks, on behalf of the Organizer, sells tickets to third parties for events entered into the Ticks system, for which the Organizer has the right to sell tickets.

The Organizer must be a duly registered, solvent legal entity (company, craftsman, association, etc.) to be allowed to sell tickets through the Ticks system. The sale of tickets through the Ticks system is not allowed for individuals, and the proceeds from ticket sales cannot be transferred to the account of an individual.
In case of false representation by the user who created the event in the Ticks system, inaccurate data entry about the Organizer's company, or if the user is not authorized to represent the Organizer's company - Ticks will cancel all tickets sold and refund the ticket buyers.
The Organizer is responsible for the data entered into the Ticks system. By entering the Ticks system, the Organizer becomes the owner of the event and the ticket issuer for the event entered into the Ticks system.

The Organizer undertakes to deliver the contracted product/service in the highest possible quality, respecting quality standards equal to or higher than those applied in regular business with customers.

The Organizer is responsible for all claims, liabilities, and costs of customers, as well as any compensation for the requested value of unused Ticks tickets incurred by the Organizer's responsibility.

For any potential issues related to the delivery or deficiency of products/services provided by the Organizer, the Organizer is solely responsible.

The Organizer is responsible for all charges and obligations related to the final ticket price.

The Organizer is responsible for the event program and bears responsibility for the terms and rules of conduct at the event venue, as well as any injuries, illnesses, damages caused entirely or in part by the Organizer's actions.

Ticks Commission and Revenue Payment to the Organizer

Unless otherwise agreed, Ticks will calculate a mediation commission to the Organizer in the amount of:
• 6.5% + 0.00 EUR for tickets priced higher than 5.00 EUR
• 0% + 0.50 EUR for tickets priced at 5.00 EUR or less.
The above commission amounts are calculated on the gross ticket sales price, and the final commission amount is increased by 25% VAT. Ticks charges the end ticket buyers a Ticket Issuing Fee in the amount of:
• 1.00 EUR (including VAT) for tickets cheaper than 20.00 EUR.
• 1.50 EUR (including VAT) for tickets priced at 20.00 EUR or higher for each issued ticket.
These amounts are gross (with VAT) and are charged to the end customer for each sales channel (internet, sales points, etc.) and for each payment method (cash, cards, bank transfer, etc.).
When creating an event through the Ticks system, the Organizer has the option to take over the Ticket Issuing Fee, meaning that the end customer pays only the ticket price, and the total cost to the Organizer, in addition to the mediation commission, is increased by the Ticket Issuing Fee, in the amount of:
• 1.00 EUR (including VAT) for tickets cheaper than 20.00 EUR.
• 1.50 EUR (including VAT) for tickets priced at 20.00 EUR or higher for each paid commercial ticket.

The Ticket Issuing Fee is not calculated for free tickets, tickets with a 100% discount, or other tickets for which the buyer has not made a payment.

Ticks undertakes to pay the Organizer the earnings from ticket sales, reduced by the mediation commission and other related costs, within ten (10) business days from the end of the event unless another deadline is agreed upon. Payment will be made under the condition that the event was properly held, and it will be made to the account and according to the data that the Organizer entered into the Ticks system when organizing the event.

The payment of money to the Organizer's account is considered successful fulfillment of Ticks' part of the contract.

Cancellation of Transaction by the Bank

The Organizer is aware of the risk that payments through certain payment methods (debit and credit cards) may be withdrawn or canceled by the bank in certain cases, such as customer complaints. The Organizer bears this risk entirely. If the bank cancels the payment after Ticks has already paid the money to the Organizer, the canceled payment amount, increased by the costs of payment withdrawal, will be charged to the Organizer.

Cancellation, Change of Date, or Significant Change in the Event Program

The Organizer undertakes to immediately inform Ticks in writing (via email) about possible threats, definite event cancellations, or other situations that would require a refund to customers. In the event of event cancellation, significant changes in the program or location, changes in dates and/or times, or similar significant changes related to the event that could result in the obligation to refund customers (hereinafter referred to as "event cancellation"), the Organizer assumes the legal obligation and responsibility to refund the full price of paid tickets to end customers. Whenever possible, if Ticks has not previously paid the ticket sales revenue to the Organizer, the refund to customers will be made by the Organizer's order and on behalf of the Organizer directly through Ticks. For all tickets purchased through the Ticks system for which Ticks has already paid the agreed amount to the Organizer, the refund to customers will be made by the Organizer depositing the full price of the sold tickets into Ticks' bank account within 7 days of the public announcement of the situation. The Ticket Issuing Fee and any other fees or additional services provided by Ticks that the customer paid to Ticks with the ticket are non-refundable. In the event of event cancellation, delay, or other reasons for a refund of purchased tickets, these services and fees will not be refunded. In the event of event cancellation, Ticks cannot be held responsible towards Visitors and/or third parties for any damage and/or possible lawsuits. If there are indications that the Organizer's business is endangered (such as over-indebtedness, inability to pay, bank account blockade, etc.) or if there is a reasonable suspicion that the event will not take place, Ticks reserves the right to suspend ticket sales and all payments to the Organizer. If it is later determined that the event did take place, Ticks will pay the Organizer the sales amount according to the agreed conditions. For tickets for which Ticks has refunded customers due to cancellation, change of event date, or at the explicit request of the organizer, Ticks will charge the Organizer only the agreed sales commission. Ticks will perform the service of refunding money to customers at its own expense, and no additional fee will be charged to the Organizer in addition to the agreed sales commission.

General Data Protection Regulation (GDPR)

As a Data Processor responsible for processing personal data transmitted by Ticks in the capacity of a Data Controller, the Organizer is subject to all provisions of Article 28 of the General EU Regulation 2016/679 on personal data protection.

The Organizer specifically undertakes the following:
• The Organizer agrees to handle customer personal data obtained through the Ticks system as a Data Processor responsibly, carefully, and exclusively according to the European General Data Protection Regulation (GDPR).
• The Organizer agrees to collect only additional customer data that may be processed to the extent necessary for the purpose (ticket purchase) – everything related or can be related to it – such as shirt sizes, addresses or areas of residence, gender, food or drink preferences, etc.
• If Special categories of data are collected, they must be collected entirely voluntarily and with the explicit consent of the user for special categories.
• The Organizer will never use the ticket sales system for children under 16 years of age. The use of the Ticks system is strictly prohibited for children under 16 years of age.
• If the Organizer wants to collect email addresses from customers for later marketing such as sending newsletters, the Organizer is obliged to obtain explicit consent from the customer to use the email for this purpose. Consent can be included in the purchase process using an additional checkbox, for example, named "I want to receive email newsletters from the Organizer with the latest events."
Children under 16 years of age are strictly prohibited from using the Ticks system. • To comply with the GDPR, it is desirable for the Organizer to have their own Data Protection Statement published on the internet, which can then be incorporated into their Ticks event as an additional checkbox, for example, named "I agree and accept the Organizer's Data Protection Statement."
• For the processing of data requested by the event organizer for organizational purposes, the organizer of the event is solely responsible.
• Non-compliance with the Agreement or these rules entails an obligation to report a personal data breach to the National regulatory body (AZOP) by Ticks.
